USITC Makes Decision on Cut-to-Length Carbon Steel Plate

The U.S. International Trade Commission (USITC or Commission) has determined that revoking the existing antidumping (AD) and countervailing duty (CVD) orders on cut-to-length carbon-quality steel plate from India, Indonesia, and Korea would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time.
 
The Commission also determined that revoking the existing AD and CVD orders on cut-to-length carbon steel plate from Italy would not be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time. The Commission further determined that revoking the AD order on such plate from Japan would not be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time.
 
As a result of the Commission's affirmative determinations, the existing orders on imports of these products from India, Indonesia, and Korea will remain in place. As a result of the Commission's negative determinations, the existing orders on imports of these products from Italy and Japan will be revoked.
 
With respect to India, Indonesia, and Korea, all six Commissioners voted in the affirmative. Regarding Italy, Chairman Deanna Tanner Okun and Commissioners Daniel R. Pearson, Shara L. Aranoff, and Dean A. Pinkert voted in the negative; Vice Chairman Irving A. Williamson and Commissioner Charlotte R. Lane voted in the affirmative.
 
With respect to Japan, Okun, Williamson, Pearson, and Aranoff voted in the negative; Lane and Pinkert voted in the affirmative.
 
The action comes under the five-year (sunset) review process required by the Uruguay Round Agreements Act, which requires the Department of Commerce to revoke an AD or CVD order, or terminate a suspension agreement, after five years unless the Department of Commerce and the USITC determine that revoking the order or terminating the suspension agreement would be likely to lead to continuation or recurrence of dumping or subsidies (Commerce) and of material injury (USITC) within a reasonably foreseeable time.
  
The sunset reviews concerning cut-to-length carbon-quality steel plate from India, Indonesia, Italy, Japan, and Korea were instituted on November 10, 2010.
