ITC to Uphold Duties for Stainless Butt-Weld Pipe Fittings

Nov. 1, 2006 — The U.S. International Trade Commission (ITC) announced that it will uphold existing antidumping duty orders on stainless steel butt-weld pipe fittings from Italy, Malaysia, and the Philippines.

The Uruguay Round Agreements Act requires the Department of Commerce to revoke an antidumping or countervailing duty order, or terminate a suspension agreement, after five years unless the Department of Commerce and the ITC determine that revoking the order or terminating the suspension agreement would be likely to lead to continuation or recurrence of dumping or subsidies (Commerce) and of material injury (ITC) within a reasonably foreseeable time.

The decision follows a recent affirmative finding by the Department of Commerce, as well as the Commission’s subsequent determination that revoking the existing order would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time.

All six Commissioners found that revoking the existing orders would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time.

The five-year (sunset) reviews concerning Stainless Steel Butt-Weld Pipe Fittings from Italy, Malaysia, and the Philippines were instituted on January 3, 2006. On April 10, 2006, the Commission voted to conduct full reviews.
