ITC to Uphold Duties for Ferrovanadium and Nitrided Vanadium

Sep. 19, 2006 — The U.S. International Trade Commission (ITC) announced that it will uphold an existing antidumping duty order on ferrovanadium and nitrided vanadium imported from Russia.

The Uruguay Round Agreements Act requires the Department of Commerce to revoke an antidumping or countervailing duty order, or terminate a suspension agreement, after five years unless the Department of Commerce and the ITC determine that revoking the order or terminating the suspension agreement would be likely to lead to continuation or recurrence of dumping or subsidies (Commerce) and of material injury (ITC) within a reasonably foreseeable time.

The decision follows a recent affirmative finding by the Department of Commerce, as well as the Commission’s subsequent determination that revoking the existing order would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time. All six Commissioners voted in the affirmative.

The five-year (sunset) review concerning Ferrovanadium and Nitrided Vanadium from Russia was instituted on May 1, 2006. On August 4, 2006, the Commission voted to conduct an expedited review.
