Commerce Preliminarily Finds Dumping of Imports of Welded Stainless Pressure Pipe

Synalloy Corp., a holding company owning subsidiaries that engage in a number of diverse business activities including the production of stainless steel pipe, fiberglass and steel storage tanks, specialty chemicals and fabrication of stainless and carbon steel piping systems, announced that on 31 December 2013, the Department of Commerce announced its affirmative preliminary determinations in the antidumping duty (AD) investigations of imports of welded stainless pressure pipe from Malaysia, Thailand, and the Socialist Republic of Vietnam. In 2012, imports of welded stainless pressure pipe from Malaysia, Thailand, and Vietnam were valued at an estimated US$18.6 million, US$22.9 million, and US$18 million, respectively.

Commerce will instruct U.S. Customs and Border Protection to require cash deposits based on the preliminary rates calculated in these investigations from the date of the preliminary ruling forward. In the case of Malaysia, Commerce also determined that "critical circumstances" exist for the major respondents and has imposed these preliminary rates effective 90 days prior to the publication of the preliminary determination in the Federal Register.
 
The petitioners for these investigations are Bristol Metals LLC (Tenn.), Felker Brothers Corp. (Wis.), and Outokumpu Stainless Pipe, Inc. (Ill.). The product covered by the scope of these investigations is circular welded austenitic stainless pressure pipe not greater than 14 inches in outside diameter. For purposes of this scope, references to size are in nominal inches and include all products within tolerances allowed by pipe specifications ASTM A-312, ASTM A-778 specifications and ASTM A-358 when they are produced to meet ASTM A-312 or ASTM A-778 specifications.
 
Commerce is scheduled to announce its final determinations on or about 17 May 2014 and the U.S. International Trade Commission will make its final injury determination in July 2014.
