Carpenter Technology Files Complaint against Allegheny Technologies

Carpenter Technology Corp. has filed a lawsuit against Allegheny Technologies Inc. (ATI) alleging that two U.S. patents obtained by ATI are not valid.
Carpenter filed the lawsuit in the United States District Court for the Eastern District of Pennsylvania in Philadelphia to challenge the validity of two U.S. patents (564 and 858) issued to ATI regarding a method of producing and manufacturing 30-inch diameter 718 ingots of nickel-based alloys.
Carpenter, which manufactures and sells ingots of various dimensions of a nickel base 718 alloy at its Reading, Pa., manufacturing location, is seeking a declaration that it has not infringed on or is not infringing on the patents in question, and seeks an order that the patents issued to Allegheny are not valid.
Carpenter sells these products primarily into the aerospace market, where demand currently exists. Before the issuance of the patents, Carpenter made substantial preparations to produce nickel base 718 Alloy ingots in sizes greater than 30 inches in diameter, according to the complaint.
Carpenter Technology produces and distributes specialty alloys, including stainless steels, titanium alloys and superalloys, and various engineered products.
