Canadian Tribunal to Initiate Expiry Review of Welded Pipe

The Canadian International Trade Tribunal will initiate an expiry review of its order on carbon steel welded pipe from the Republic of Korea.

The case addresses carbon steel welded pipe ranging in size from 12.7 to 406.4 mm (1/2 to 16 inch) in various forms and finishes, usually supplied to meet ASTM A53, ASTM A120, ASTM A252, ASTM A589 or AWWA C200-80 or equivalent specifications. Water well casing, piling pipe, sprinkler pipe and fencing pipe are included, but oil and gas line pipe made to API specifications are excluded, as is lightwall sprinkler pipe that meets the requirements of ASTM A135 and/or A795.

Interested persons and governments were informed of the expiry when Notice of Expiry No. LE-2004-004 was issued on August 3, 2004. The Tribunal is of the opinion that a review of the order is warranted, and has notified the Canada Border Services Agency (CBSA), as well as other interested persons and governments, of its decision.

In its expiry review, the CBSA must determine whether the expiry of the order in respect of carbon steel welded pipe is likely to result in the continuation or resumption of dumping.

The CBSA must provide notice of its determination no later than January 20, 2005. If the CBSA determines that the expiry of the order in respect of any goods is unlikely to result in the continuation or resumption of dumping, the Tribunal will issue an order rescinding the order with respect to those goods.

If the CBSA determines that the expiry of the order in respect of any goods is likely to result in the continuation or resumption of dumping, the Tribunal will then conduct an inquiry to determine if the continued or resumed dumping is likely to result in injury or retardation. The Tribunal’s public hearing for evidence and representations by interested parties will commence on April 12, 2005.
