Canadian Tribunal to Initiate Expiry Review of Hot Rolled Plate Imports

The Canadian International Trade Tribunal will initiate an expiry review of its June 27, 2000, finding (Inquiry No. NQ-99-004) concerning the dumping in Canada of hot-rolled carbon steel plate from Brazil, Finland, India, Indonesia, Thailand and Ukraine, and the subsidizing of hot-rolled carbon steel plate from India, Indonesia and Thailand.

Based on responses to Notice of Expiry Number LE-2004-005, issued on August 24, 2004, the Tribunal is of the opinion that a review of the finding is warranted. The Tribunal has notified the Canada Border Services Agency (CBSA), as well as other interested persons and governments, of its decision.

In this expiry review, the CBSA must determine whether expiry of the finding for hot-rolled carbon steel plate is likely to result in the continuation or resumption of dumping and subsidizing of the goods.

If the CBSA determines that expiry of the finding is likely to result in the continuation or resumption of dumping and subsidizing, the Tribunal will then conduct an inquiry to determine if the continued or resumed dumping and subsidizing is likely to result in injury or retardation. If the CBSA determines that expiry of the finding is unlikely to result in continuation or resumption of dumping and subsidizing, the Tribunal will issue an order rescinding the finding with respect to those goods.

The CBSA must provide notice of its determination within 120 days after receiving notice of the Tribunal’s decision to initiate an expiry review, that is, no later than February 10, 2005.
