ITC to Uphold Duties on Steel Pipe from One Country, Revoke Duties for Two

The U.S. International Trade Commission (ITC) announced that it will uphold an existing antidumping duty order on seamless carbon and alloy steel standard, line, and pressure pipe from Germany, but that it would revoke similar orders for the same products imported from Argentina and Brazil.

The decision for the order on imports from Germany follows a recent affirmative finding by the Department of Commerce, as well as the ITC’s subsequent determination that revoking the order would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time. The ITC had determined that revoking the order for imports from Brazil and Argentina would not be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time, hence this order was revoked.

With respect to Argentina and Brazil, Chairman Daniel R. Pearson, Vice Chairman Shara L. Aranoff, and Commissioners Deanna Tanner Okun and Irving A. Williamson voted in the negative; Commissioner Charlotte R. Lane voted in the affirmative. With respect to Germany, Vice Chairman Aranoff and Commissioners Lane and Williamson voted in the affirmative; Chairman Pearson and Commissioner Okun voted in the negative. Commissioner Dean A. Pinkert did not participate in these reviews.

Today's action comes under the five-year (sunset) review process required by the Uruguay Round Agreements Act. See the attached page for background on these five-year (sunset) reviews.
